Welcome, and thank you for choosing The Life Harvest. These Terms and Conditions explain how we work together when you order our food, book our catering, sign up to our emails, use our website or, in future, join one of our online courses or buy a digital product. We have written them to be clear and fair, so you know what to expect from us and what we ask of you in return.
The Life Harvest is operated by Milena Minichiello trading as The Life Harvest based in Tallebudgera Valley on the Gold Coast, Queensland, Australia. In these terms, “we”, “us” and “our” mean The Life Harvest, and “you” and “your” mean you, our customer, client or website visitor. You can reach us any time at milena@thelifeharvest.com.
By ordering from us, using our website or signing up to hear from us, you agree to these terms. If anything here does not sit right with you, please email us before you order and we will do our best to help.
Agreement and changes
These terms apply to everything we offer, including our meals, catering, website, emails, and any digital products or courses we release in future. We may update them from time to time as our business grows or the law changes, and when we do we will update the date at the top of this page. The version that applies to your order is the one in place at the time you place it.
Who can order
You need to be at least 18 years old to place an order or enter into an agreement with us. By ordering, you confirm that you are, and that the details you give us are current, accurate and complete.
Our food and how ordering works
We make small-batch, whole-food meals with care, and we sell them mainly through a monthly pre-order. When pre-orders open, you choose your meals and pay at checkout, and orders close on the cut-off date shown at the time. Because everything is cooked fresh and to order, we begin planning and prepping around the orders we receive.
If you need to change or cancel an order, please email us as soon as you can. We handle these requests case by case and will always try to help where we reasonably can, though once we have begun shopping and prepping for your order we may not be able to make changes.
Food, allergens and your wellbeing
Your health matters to us, so please read this part carefully. Our food is prepared in a kitchen that also handles common allergens including nuts, dairy, gluten, eggs, soy and sesame. While we take great care, we cannot guarantee any meal is completely free from traces of these. If you have a serious allergy or intolerance, please tell us before ordering, check with us if you are ever unsure, and read the ingredient information we provide.
Once your meals are delivered or collected, please refrigerate or freeze them promptly and follow any storage and reheating guidance we give, as their safety and quality from that point is in your hands.
Any nutrition guidance or coaching we provide is general in nature and made with care, but it is not a substitute for personalised advice from your doctor or a qualified health professional, especially if you have a medical condition, are pregnant, or have specific dietary needs.
Delivery and collection
We deliver locally within our set areas and on our set days, and we will let you know the delivery or collection details for your order. Please make sure someone is available to receive your delivery, or that we have safe and clear instructions, as we cannot take responsibility for meals left according to your instructions or spoiled because no one was available to receive them.
Pricing and payment
All prices are in Australian dollars and include GST where it applies. Payment is made at checkout through our website (WooCommerce) and our trusted payment providers, and we do not see or store your full card details. You authorise us to charge your chosen payment method for the total shown at checkout, including any delivery fees.
We may update our prices at any time for future orders. If a genuine pricing error occurs, we will let you know in writing before processing your order so you can decide how you would like to proceed.
Catering
We love catering for retreats, workshops and events. To secure your date, we ask for a deposit of 50% with the balance due 7 days before your event. Your date is confirmed once we receive your deposit.
If you need to cancel or postpone, please tell us as early as possible. Your deposit covers the planning and preparation we set aside especially for you, so it is non-refundable, and cancellations within 14 days of the event may require payment of the full amount, as by then we have usually committed to ingredients and scheduling. We will always be reasonable and work with you where we can.
Your rights under the Australian Consumer Law
Nothing in these terms takes away the rights and guarantees you have under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded, including that they are of acceptable quality and match their description, and our services come with a guarantee that they will be provided with due care and skill.
If something we provide is faulty, unsafe, or not as described, you are entitled to a remedy, which may include a repair, replacement or refund depending on the situation, along with compensation for any reasonably foreseeable loss. Please contact us at milena@thelifeharvest.com and we will make it right.
Change of mind and refunds
Because our food is fresh, perishable and made to order, we are generally not able to offer refunds simply for a change of mind, though as noted above we look at change and cancellation requests case by case and will help where we reasonably can. This does not affect your consumer guarantee rights above, which always apply.
Digital products and courses
Our online course and ebook are still in the making and are not yet available to buy. When we do release them, these terms will apply, along with any specific terms shown at the point of purchase.
When you buy a digital product or course from us, you receive a personal, non-transferable licence to access and use it for yourself. Please do not share, copy, resell or republish it, as a great deal of love and work goes into creating these. Because digital products are delivered instantly and cannot be returned, change-of-mind refunds are not available on them, but your Australian Consumer Law rights still apply if something is faulty or not as described.
Our intellectual property
Everything on our website and in our emails, including our original recipes, words, photographs, designs, graphics, logo and brand name, is the intellectual property of The Life Harvest. We share our recipes so you can cook and enjoy them at home, and you are always welcome to do that freely.
If you would like to share one of our recipes more widely, whether on social media, a blog, a newsletter or any other channel, we simply ask that you credit The Life Harvest as the source, link back to our website or newsletter where you can, and tag us so we can see it and say thank you. Please do not republish our recipes, photographs or other content in full, present them as your own, or use them commercially without our written permission. If you are ever unsure, just email us and ask, as we are usually delighted to say yes.
Reviews and contributions
We would love for you to share your experience. If you leave a review, comment or photo on our website or social channels, please keep it honest, based on your genuine experience, and free of anything offensive, discriminatory, misleading or unlawful. By sharing content with us, you give us permission to re-share it in our own marketing with credit where appropriate, and you confirm it is yours to share. We may choose whether to publish or keep any submission, and reviews reflect the views of those who write them rather than ours.
Disclaimers
Our website, emails and materials are provided for general information and to share what we love about good food. We take care to keep them accurate and up to date, but we cannot promise they are always complete, current or error-free, and you rely on them at your own discretion. If you spot something that needs fixing, we would be grateful if you let us know.
Limitation of liability
To the extent permitted by law, and other than the consumer guarantees and rights described above which always apply, we are not liable for any loss or damage arising from your use of our website, food or other offerings beyond what the law requires of us. Nothing in these terms limits any liability that cannot lawfully be limited or excluded under the Australian Consumer Law.
Links to other websites
Our website and emails may include links to other sites we think you will enjoy. Once you leave ours, we are not responsible for those websites or their content, so please read their terms and privacy policies before using them.
Suspending or ending access
We may limit, suspend or end your access to our website or offerings if we reasonably believe you have breached these terms or used our services unlawfully. You can also stop using our website and unsubscribe from our emails at any time.
Resolving any concerns
If something goes wrong, please talk to us first, as most things are easily sorted with a friendly email. If we cannot resolve a concern together, we both agree to make a genuine attempt to resolve it through mediation before starting any legal proceedings.
Governing law
These terms are governed by the laws of Queensland, Australia, and any dispute will be handled by the courts of Queensland.
Privacy
We handle your personal information in line with our Privacy Policy, which forms part of these terms. Please read it to understand how we collect, use and protect your information.
General
If any part of these terms is found to be unenforceable, the rest will still apply. These terms, together with our Privacy Policy and anything shown at your point of purchase, make up the whole agreement between us. Any rights we have not expressly given up here are reserved.
